1. Introduction
Welcome to SharedResourceMatrix ("we," "our," or "us"). These Terms & Conditions ("Terms") govern your use of our yacht charter services and website located at sharedresourcematrix.sbs (the "Service") operated by SharedResourceMatrix.
By booking a charter or accessing our Service, you agree to be bound by these Terms. If you disagree with any part of these terms, then you may not access the Service.
2. Service Overview
SharedResourceMatrix offers top-tier yacht charter services, which include but are not limited to:
- Daily yacht rentals
- Sunset cruises
- Corporate retreats
- Private events
- Multi-day excursions
Our services are offered subject to availability and weather conditions. We maintain the right to change or stop services without prior notice.
3. Booking and Reservations
3.1 Booking Process
To secure a booking for a charter, the following conditions must be met:
- Minimum age of 18 years
- Provision of accurate and full details
- Payment of deposit as outlined in your booking confirmation
- Acceptance of these Terms & Conditions
3.2 Confirmation
Your reservation is only guaranteed once payment is received and we provide confirmation in writing. We may deny service at our sole discretion.
3.3 Availability
Scheduling of charters is contingent upon yacht availability and appropriate weather conditions. We will endeavor to honor your chosen dates and times wherever possible.
4. Payment Terms
4.1 Pricing
All listed prices are in € and encompass all applicable taxes unless stated otherwise. Prices are subject to alterations without pre-announcement.
4.2 Payment Timeline
- Deposit: 50% of the total charter fee is due upon booking
- Remaining Balance: Must be paid 48 hours prior to the charter departure
- Any additional expenses (if incurred): Payable at the conclusion of the charter
4.3 Methods of Payment
Purchase can be completed through major credit cards, electronic bank transfers, and certified cheques. Transactions are processed using secured and encrypted methods.
5. Cancellation and Refund Policy
5.1 Customer Initiated Cancellations
- More than 72 hours prior to departure: Full refund minus transaction fees
- Within 24-72 hours of departure: 50% of the payment is refunded
- Less than 24 hours before departure: No refund will be given
5.2 Cancellations Due to Weather
In the event that our captain determines unsafe weather conditions, we may provide the option to:
- Reschedule the charter to an alternate date without additional cost
- Issue a complete refund if rescheduling isn't feasible
5.3 Mechanics Issues
Should mechanical failures occur with your designated vessel, efforts will be made to supply a comparable alternative. If substitution is not possible, a full reimbursement will be issued.
6. Safety and Conduct
6.1 Safety Protocols
Every passenger is expected to:
- Heed all instructions from the crew
- Utilize safety apparatus when it is called for
- Disclose any health conditions that may impede their safety
- Stay within the designated regions of the yacht
6.2 Restricted Items
The following articles are banned on the vessel:
- Glassware
- Illegal substances
- Firearms or any form of weaponry
- Limited consumption of non-alcoholic beverages such as juice or soda
- Pets (with exceptions upon prior approval)
6.3 Behavior Expectations
Passengers are to behave respectfully at all times. Any charter can be terminated prematurely without reimbursement if a passenger’s behavior becomes a safety hazard or disturbs the enjoyment of others.
7. Liability and Insurance
7.1 Our Liability Limitations
Our responsibility is confined to the total amount paid for your charter and does not cover:
- Personal injuries as a result of passenger negligence
- Property loss or damage
- Indirect or consequential damages, nor punitive reparations
- Delays attributed to weather or other events out of our jurisdiction
7.2 Insurance Policies
Comprehensive marine insurance is in place that covers our fleet and operations. Clients must arrange personal travel insurance and personal item coverage.
7.3 Assumption of Risk
By participating in our charter services, clients accept that maritime activities come with inherent dangers, and assume all responsibility for their personal safety and health.
8. Modifications and Itinerary Changes
Changes to itineraries, journeys, or schedules may be made in response to weather, safety, or operational necessities. Every effort will be directed towards offering a comparable alternative experience.
9. Force Majeure
We cannot be held accountable for any hold-ups, cancellations, or alterations that are brought about by forces beyond our control, which can include but are not restricted to:
- Severe weather phenomena
- Natural calamities
- Legal regulations
- Port shutdowns
- Mechanical malfunctions
10. Privacy and Data Security
Your private data is managed in line with our Privacy Policy. Engaging with our services signifies consent to our gathering and use of your information as specified in the Privacy Policy.
11. Intellectual Property
All content on this site, such as text, visuals, logos, and images, is under copyright and trademark law protection. Reproduction, distribution, or creation of derivatives is prohibited without our express written consent.
12. Governing Law
The laws of Spain dictate the interpretation of these Terms, and any disputes must be settled in the courts of Palma de Mallorca, Spain.
13. Alterations to Terms
Amendments can be made to these Terms at our discretion. Any alterations will be reflected on our site with a notice of the date of amendment. Continued use of our services indicates acceptance of the revised terms.
